Terms of Service

1. Agreeing to these terms

These terms are an agreement between you and Abundiva ("Abundiva," "we," "us"). They apply when you visit abundiva.com, create an account, run a workspace, or join a workspace as a student or member. By using Abundiva you agree to these terms, our Privacy Policy, and our Earnings Disclaimer. If you use Abundiva for a church, business, or other organization, you agree on its behalf and confirm you have the authority to do so.

You must be at least 18 years old to create a workspace. Students and members under 18 may use a workspace only with the permission and supervision of a parent or guardian and of the workspace owner.

2. What Abundiva is

Abundiva is a software platform. Workspace owners (we call them "creators") use it to run courses, communities, events, coaching, live classes, a shop, email and text messages, and a website. Creators run their own workspaces and sell to their own students and customers. Abundiva provides the tools; we are not a party to the sale between a creator and their customers.

3. Your account

Keep your login details private and tell us right away if you think someone else has used your account. You are responsible for what happens under your account and in your workspaces, including what your staff and instructors do.

4. Plans, trials, and billing

• New customers get one 14-day free trial. No card is needed to start.
• Plans are billed monthly in US dollars, in advance, by our payment processor, Stripe. Each plan includes a set number of workspaces. Extra workspaces cost $29 a month each.
• Your plan renews each month until you cancel. You can cancel at any time from Plan and billing. Your plan stays active until the end of the month you have paid for.
• Payments are not refunded for partial months or unused time, unless the law requires it.
• If a payment fails, we will try again and let you know. If it is not fixed, your workspace may pause. Pausing does not delete your content.
• We may change our prices. We will tell you at least 30 days before a price change affects you.
• Optional add-ons, such as ready-made school templates, are sold separately at the price shown when you buy.

5. Selling to your own customers

Creators connect their own Stripe account to get paid. Money from your sales goes to your Stripe account, and Stripe’s own terms and fees apply. You are responsible for your prices, refunds, taxes, receipts, customer service, and any promises you make to your customers. Your students and customers should contact you, not Abundiva, about purchases from your workspace.

6. Your content

You own the courses, videos, posts, files, pages, and other material you put into Abundiva ("your content"). You give Abundiva permission to store, copy, display, and deliver your content only as needed to run the platform for you and the people you share it with. This permission ends when you delete your content or your account, except for copies kept in backups for a limited time or where the law requires us to keep them.

You confirm that you have the rights to everything you upload, and that your content does not break the law or anyone else’s rights, including copyrights and trademarks.

7. Acceptable use

You agree not to use Abundiva to:

• Break any law, or help anyone else break one.
• Upload content you don’t have the rights to use.
• Send spam, or send email or text messages to people who have not agreed to receive them.
• Harass, threaten, or abuse anyone, or share hateful, violent, or sexually explicit content.
• Sell illegal products or make false, misleading, or fraudulent claims, including promises of income or health results you can’t back up.
• Spread viruses, try to break into accounts or systems, or interfere with how Abundiva works.
• Copy, resell, or rebuild the Abundiva platform itself.

We may remove content or pause an account that breaks these rules. Where it makes sense, we will tell you first and give you a chance to fix it.

8. Email and text messages

If you send email or text messages through Abundiva, you are responsible for having permission from the people you contact and for following the laws that apply, such as CAN-SPAM and the Telephone Consumer Protection Act. Every message must let people unsubscribe or reply STOP. Phone carriers must approve texting before it starts, and they may block messages that break their rules.

9. AI features

Abundiva includes AI tools that write drafts, answer questions, and make suggestions. AI can make mistakes. Review everything the AI writes before you use or publish it. You are responsible for what you choose to publish.

10. Services from other companies

Abundiva works with other services, such as Stripe for payments, Zoom for meetings, and your domain provider for custom domains. Your use of those services is covered by their own terms. We are not responsible for services we don’t control.

11. Partner Program

Partners earn the commission shown on the Partner Program page on paid subscriptions from people they refer. Commissions are held for 30 days before they can be paid, so refunds and failed payments can be settled. Partners may not use spam, misleading claims, or paid ads that bid on the Abundiva name. We may end a partner’s participation, and cancel unpaid commissions, for breaking these rules. See our Earnings Disclaimer.

12. Ending your account

You can stop using Abundiva and cancel your plan at any time. We may pause or close an account that breaks these terms or doesn’t pay. After an account closes, we may delete its content after a reasonable time. Download anything you want to keep before you leave.

13. No guarantees

We work hard to keep Abundiva running well, but the platform is provided "as is" and "as available." We do not promise that it will always be available, error-free, or right for your purpose, or that you will earn any amount of money by using it.

14. Limits on our responsibility

As far as the law allows, Abundiva is not responsible for lost profits, lost data, or indirect or consequential damages. Our total responsibility for any claim about Abundiva is limited to the amount you paid us in the 12 months before the claim.

You agree to protect Abundiva from claims made by others that come from your content, your workspace, your sales, or your breaking of these terms.

15. Changes to these terms

We may update these terms as Abundiva grows. If we make an important change, we will tell you by email or in the app before it takes effect. If you keep using Abundiva after a change, you accept the new terms.

16. Governing law

These terms are governed by the laws of the State of Georgia, USA. Any dispute will be handled in the state or federal courts located in Georgia, unless the law requires otherwise.
